Contracts & Clauses: The Landmark Legal Case Impacting Your Business

A recent decision by the Ontario Superior Court of Justice made it clear that the enforceability of termination clauses depends on their wording. Any termination clause that violates the Employment Standards Act will be deemed invalid. This means your employment contracts may no longer protect you from litigation. 



Employers are advised to review their contracts and termination provisions to ensure they do not breach the ESA. If your contracts are found in violation of the law, the employees you terminate may be entitled to notice or pay in lieu at common law – which would mean higher costs for you.
